Waiting 457 Visa; can we come on a visitors Visa

Hi, can anybody please advise me?

We are currently waiting for our 457 visa to arrive, and expect it before the end of January. But who knows, it may not! We have a rental booked from 2nd February and planning everything around flying out that weekend.
My question is - could we fly out on a visitors visa and wait for the 457 visa whilst in Melboune?

We just want to be there with you guys!

I know the feeling, about waiting, and not knowing when it will be granted.

We where looking at doing the same 6 months ago, and this was the reply from our migration agent at Go Matilda

"I have been checking the legislation and it appears that if you come in on an ETA visa you will be able to be granted your 457 visas whilst in Australia and you won't have to go offshore to be granted them.

I have asked your DIAC caseworker for confirmation of this.

Best regards"

Hope your visa comes through quickly, but at least you can come across before it is granted.

Hi,

Whilst waiting for our 457 visa to be issued I asked the Australian High Commision the very same question and here is their email response. By the way we didn't need it in the end but it was always a back up plan.

Thank you for your enquiry.

It is possible to apply for a Temporary Business Long Stay Visa (Subclass 457) from outside Australia and have the visa approved when you are in Australia. However you will not be able to work until your 457 visa is approved. If you intend to travel to Australia before your 457 Visa application is finalised, you will need to inform the case officer or office processing your visa application.

If you enter Australia on a one way ticket you may be asked by Australian Immigration authorities on arrival at the airport as to what your plans are for departing Australia are. You would need to explain your intentions to the officer and the officer needs to be satisfied that you do not intend to stay beyond the period which your visa allows. While not a mandatory requirement, you may wish to carry a copy of your bank statement to demonstrate you have sufficient funds to purchase an airline ticket out of Australia.

We did exactly that - partners employers wanted him to start work asap, so he came on a business ETA (and they employed him as an overseas consultant and paid him in the UK), the rest of the family came on the holiday ETA.

We came on a one way flight and got through immigration without any questions.

Kids couldnt go to school and obviously I couldnt work (we had a great 2 month holiday though), and we were issued with our 457 when we were here without any problems.

We were very lucky in that employers agreed to pay all expenses if the situation arose that the 457 didnt come through in time and we would have to leave the country.
